Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MotionCut mobile application and the website at motioncutai.com(together, the “Services”), provided by MotionCut(“MotionCut”, “we”, “us”, or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your country, you may use the Services only with the involvement and consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

2. The Service

MotionCut is an AI-powered video editor that turns your clips into edited videos based on the prompts and selections you provide. We may add, change, or remove features at any time to improve the Services.

3. Your Account

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@motioncutai.com if you suspect unauthorized use.

4. Subscriptions, Credits & Purchases

• MotionCut offers free features (including periodic AI credits) and paid plans with additional capabilities.
• Purchases and subscriptions are billed through Google Play Billingand are subject to Google Play’s terms.
• Subscriptions automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription in your Google Play account settings.
• Refunds, where available, are handled according to Google Play’s refund policy.

5. Your Content & License

You retain all ownership of the videos, images, and other media you upload (“Your Content”). You represent that you own or have the necessary rights to Your Content and that it does not infringe any third party’s rights. You grant MotionCut a limited, worldwide, non-exclusive license to host, process, and transmit Your Content solely to provide the editing features you request — including processing it through our third-party AI providers.

6. Acceptable Use

You agree not to use the Services to:

• Upload or create content that is illegal, infringing, defamatory, or harmful.
• Violate the privacy or intellectual-property rights of others.
• Create non-consensual, sexually explicit, or deceptive “deepfake” content.
• Attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the Services.
• Use the Services in any way that violates applicable laws or these Terms.

7. AI-Generated Output

AI-generated edits are produced automatically and provided on an “as is” basis. Results may vary and may not always meet your expectations. You are responsible for reviewing your edits and for how you use, publish, or distribute them.

8. Intellectual Property

The Services, including the MotionCut name, logo, software, and design, are owned by MotionCut and protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.

9. Third-Party Services

The Services rely on third parties such as Google (sign-in, AI processing, analytics, and billing) and Cloudflare (hosting). Your use of those features may also be subject to their respective terms and policies.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, MotionCut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Services. Our total liability for any claim shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.

12. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Services in a way that may cause harm or legal liability.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services are subject to the exclusive jurisdiction of the courts of India.
